The problem of limiting individual freedom of conscience and religion in mixed marriages

Abstract

The article analyzes the issue of circumstances that result in the violation or limitation of freedom of conscience or religion in the individual aspect. The author of the study wants to achieve the relevant research goals by analyzing the general as- sumptions of the General Decree of the Polish Episcopate of 2020. Within the scope of the study, the area of violations of the freedom of conscience by the spouse in the con- text of a mixed marriage (issues of changing religion, hindering religious practices) was discussed. As part of the individual protection of the freedom of conscience and religion, canonical processes, in particular – matrimonial processes, were also discussed. Especially that the issue of conscience and religion is taken into account ex officio in the course of the matrimonial process.
