Bonum familiae in the context of Pope Francis’ speech at the beginning of the judicial year of the Tribunal of the Roman Rota on January 29, 2021

Abstract

The notion of bonum familiae, although it is not a legal category in itself, appears more and more often in the context of nullity of marriage processes. It has also become a subject of an address of His Holiness Pope Francis to the officials of the Tribunal of the Roman Rota for the inauguration of the judicial year (the 29th of January, 2021). The Pope draws attention to two issues: on the one hand, bonum familiae is not a reason and it cannot be considered as the reason of nullity of marriage, on the other hand, however, it can and it should be taken into consideration by the canonical lawyers in adjudications of the nullity of marriage processes.

In this article, after defining the concept of bonum familiae, an attempt of interpretation of the Pope’s address has been undertaken within the context of can. 1691 § 1 CIC/83. An incentive to remind the parties to the process of nullity of marriage about moral and civil obligations towards each other and their offspring, provides a practical application.
