The Extraordinary Appeal in the Polish jurisdiction against a final verdict handed down by a Polish court: proceedings and admissibility as illustrated by the Polish Supreme Court Decision I NSNk 11/20 of 27 May 2021

Abstract

The subject of this article is the possibility of bringing an extraordinary appeal against a Polish court decision ending proceedings in criminal cases. Te new institution of Extraordinary Appeal was introduced in Ustawa z dnia 8 grudnia 2017 roku o Sądzie Najwyższym (the Supreme Court Act of 8 December 2017). This article analyzes Decision I NSNk 11/20 handed down by the Polish Supreme Court on 27 May 2021 and compares the way Polish jurisprudence understands the meaning of a decision concluding proceedings in a cassation appeal and an extraordinary appeal. The article shows that Decision I NSNk 11/20 stands in contradiction to the previous jurisprudence.
