Proof from private documents in trial for marriage nullity

Abstract

Together with an improvement and universality of means of electronic communication, there is noticeable growth of parties’ activity consisting of submitting different kinds of documents (e.g. text messages’ scans or electronic mail’s prints) as evidence in jurisprudence. Evidential value of such materials is often doubtful or even insignificant, first of all, because of difficulties with verification of their authenticity. It happens, however, that this type of evidence proves useful for the case. The aim of present submission is a try of critical assessment of private documents’ suitability as proof in canonical trial for marriage nullity.
