Marital separation – fiction of indissolubility or the chance of permanence of a relationship?

Abstract

The article presents the institution of separation in canon law and the reference to separation in Polish law, in connection with the 21st anniversary of the enactment of the Act introducing the separation in 1999. Church courts in Poland do not rule on the separation of spouses, and in Polish law this possibility has been abolished after 1945. Part of the Polish society hoped for rescue of the marriage in the separation and the protection of its permanence, however, the statistical data reveal little interest in the accepted form of maintaining the relationship. Separation can resolve a conflict of conscience among Catholics proceeding from divorce.
